There's no such thing as over–protection when it comes to defending yourself against disaster while buying a home. A handy piece of added protection is the insurance indemnity policy, which can save a transaction. You might, for example, be able to amend a defective lease when purchasing a leasehold flat but that can be costly and time–consuming (and all parties need to co-operate) An alternative solution could be an indemnity policy that covers you for a variety of situations where restrictive covenants affecting your property have been broken – for example, a block of flats on land where only houses should have been built: where there are no rights of way over access routes; for lost documents, where the landlord has disappeared and ground rent has not been paid, for breaches of planning permission on lack of building, regulations approval for alterations, or where the seller has a less than perfect title to the land being sold.
Indemnity policies can also be very useful when there are inadequate buildings insurance arrangements in a block of flats. For examples, your flat might be damaged by a fire started in a communal hallway that isn't covered by an insurances policy. In this case, you could make a claim under your indemnity policy.
Indemnity cover can quickly be arranged by your solicitor. Many specialist insurers are willing to offer indemnity policies-your solicitor will have contacts. And some of us are authorised to issue standard policies on behalf of the insurer.
